Terms of Use for RunTick
These Terms of Use ("Terms") govern your access to and use of the RunTick mobile application and website (the "Service"), operated by RunTick ("we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. If you are a minor, you may use the Service only with the involvement and consent of a parent or legal guardian.
2. Your account
To use the Service you create an account using Google Sign-In or email. You are responsible for:
- Providing accurate information;
- Maintaining the confidentiality of your credentials;
- All activity that occurs under your account.
Notify us promptly at [email protected] of any unauthorized use.
3. License to use the Service
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. You may not copy, modify, reverse engineer, decompile, distribute, resell, or create derivative works of the Service except as permitted by law.
4. Health, fitness, and safety disclaimer
Please read this section carefully.
RunTick is a fitness-tracking tool, not a medical device. The Service does not diagnose, treat, or prevent any disease or health condition.
- Consult a professional before beginning any exercise program. If you experience pain, dizziness, or any concerning symptom during activity, stop and seek medical attention.
- Assumption of risk. Physical activity carries inherent risks including injury. You voluntarily assume all risks associated with your use of the Service.
- Data accuracy. GPS, distance, pace, and heart rate measurements are estimates and may be inaccurate. Do not rely on the Service's data for medical decisions.
You are solely responsible for your health and safety while using the Service.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose;
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service or our systems;
- Upload malicious code or circumvent security measures;
- Misrepresent your identity or impersonate others.
We may suspend or terminate your access for violations.
6. Your data and content
You retain ownership of the activity data you generate (runs, routes, heart rate records). You grant us a limited license to host, store, process, and display this data solely to operate and provide the Service to you. Our handling of your personal information is described in our Privacy Policy. Your data is not shared with other users.
7. Third-party services
The Service relies on third-party services including Google Play services and Google Sign-In. Your use of those services is subject to their respective terms and policies. We are not responsible for third-party services we do not control.
8. Disclaimers of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or that data will be accurate or preserved.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUNTICK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR PERSONAL INJURY ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Termination
You may stop using the Service and delete your account at any time at runtick-app.com/account. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 4, 6, 8, and 9) will survive.
11. Changes to these Terms
We may modify these Terms from time to time. We will post the updated Terms with a new "Last updated" date. Continued use after changes take effect constitutes acceptance.
